====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 8.3.2014 in a case registered for the offences punishable under Sections 20,22,23 and 24 of the NDPS Act.
From the possession of the petitioner 5.4 Kg. charas (hemp) and 4 Kg ganja along with mobile were recovered. It is submitted by the learned counsel for the petitioner that the investigation has already concluded and petitioner is in custody since 8.3.2014. However, learned counsel for the State submits that charges have already been framed and the trial has commenced.
Considering the present stage of trial and the recovery of commercial quantity of charas (hemp), this court is not inclined
Patna High Court Cr.Misc. No.58571 of 2015 (2) dt.04-01-2016 2/2 to grant bail to the petitioner in connection with Raxaul P.S. Case No. 69 of 2014 pending in the court of learned Additional District and Sessions judge cum Special Judge, East Champaran at Motihari.
This application is, accordingly, dismissed.
