JUSTICE SUDHIR SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 149, 341 and other allied Sections of the Indian Penal Code.
Allegation against the petitioners is that they assaulted son of the informant and her other family members. It is submitted on behalf of the petitioners that they have got no criminal antecedent. General and omnibus allegation has been made. No specific injury against the petitioners has been attributed. It is a case and counter case between the parties. On behalf of the State, it is submitted that from perusal of the injury report it is evident that the injury is on the head of the victim and the opinion has been reserved.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners, same is rejected.
Any how, if petitioners surrender in the court below, i.e., learned S.D.J.M., Bhagalpur, in connection with Pirpainti P. S. Case no. 150 of 2015 within a period of six weeks from the date of
Patna High Court Cr.Misc. No.8090 of 2016 (3) dt.28-03-2016 2/2 receipt of a copy of this order and pray for regular bail, same shall be considered and disposed of on its own merit preferably on the same day without being prejudiced by this order. (Sudhir Singh, J) sudip/- U T
