====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-09-2021 Heard Mr. Arun, learned counsel for the petitioners and Mr. Narendra Kumar Singh, learned APP for the State.
The petitioners seek bail in anticipation of their arrest in connection with Supaul Mahila P.S. Case No. 11/2019 instituted for the offence under Sections 498A, 323, 341, 504, 506, 379, 509 and 34 of the Indian Penal Code.
The petitioner no. 1 is the father-in-law of the
Patna High Court CR. MISC. No.5795 of 2021(2) dt.17-09-2021 2/3 informant whereas the petitioner nos. 3 and 4 are her brothers-in-law and petitioner no. 4 is the sister-in-law of the informant.
Though there is an accusation in the First Information Report of the petitioners having played active part in harassing the informant but the learned counsel for the petitioners has submitted that such accusation was found to be false in police investigation. However, differing with the police report, cognizance has been taken against these petitioners also along with other accused persons against whom chargesheet was submitted.
The husband of the informant has been granted bail by a Bench of this Court.
Regard being had to the relationship of the petitioners with the informant of this case and taking into account that her husband has been granted bail, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing
Patna High Court CR. MISC. No.5795 of 2021(2) dt.17-09-2021 3/3 bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Supaul, in connection with Supaul Mahila P.S. Case No. 11/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
