2. The petitioners apprehend arrest in connection with Jamui P.S. Case No. 253 of 2023 instituted under Sections 147, 148, 149, 341, 323, 353, 307, 323, 337, 279, 188 and 504 of the Indian Penal Code.

3. As per the prosecution case, all the FIR named accused persons, including these petitioners, are involved in illegal mining and storage of sand.

4. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in the case. It is further submitted that there is

No.56165 of 2024(2) dt.31-08-2024 2/2 general and omnibus allegation of assault against all the FIR named accused persons, including these petitioners, but there is no injury report on record. The petitioners are neither driver nor owner of the tractor in question and they have got no concern with seized tractor.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Jamui P.S. Case No. 253 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
