The petitioner seeks bail in Chandi P.S. Case No. 2/2019, instituted for offence under Section(s) 341, 323, 307, 302, 379, 504/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is no allegation of specific overt act against this petitioner in the written report. There is specific allegation of assaulting the informant against Mohan Singh.

It is alleged in the written report that on the date of occurrence petitioner along with other named accused persons came to the shop of informant and took cigarette. The informant demanded the cost of cigarette then all the accused persons abused him. It is alleged that co-accused Mohan Singh called

It is further alleged that Mohan Singh gave Tangi blow to the informant causing injury on his head and shoulder. On alarm, father of informant came to save him then Mohan Singh ordered to kill him. Thereafter all the accused persons assaulted the father of informant, who subsequently died.

In the impugned order it is found mentioned that in the post-mortem report of deceased, doctor has opined that father of informant died due to head injury caused by sharp edged objects.

Petitioner is in custody since 28.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. XIIth, Bhojpur at Ara, in connection with Chandi P.S. Case No. 2/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
