This is an application for anticipatory bail in connection with Complaint Case No. 1006 of 2018, registered for the offences, punishable under Sections 323, 498A and 506/34 of the Indian Penal Code, including Sections 3 and 4 of the Dowry Prohibition Act.
Petitioner No.1 is the mother-in-law and petitioner no.2 is the father-in-law of the complainant. Learned counsel for the petitioners, has submitted that matrimonial dispute between the complainant and her husband is the basic reason why the present complaint case has been registered. It is also the petitioners' case that prior to filing of the complaint case, the petitioners' son had filed an application in the Family Court, Gaya, for dissolution of
Patna High Court CR. MISC. No.47619 of 2019(2) dt.31-07-2019 2/2 marriage. The implication of the petitioners is because they are mother and father, respectively, of the husband of the complainant, learned counsel for the petitioners contends. Considering the above, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gaya, in connection with Complaint Case No. 1006 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
