JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.3.2018, seeks bail in Patahi PS Case No. 63 of 2015 registered under Sections 302 and 201 of the IPC.

The allegation in brief is that the informant found his daughter and her husband missing from the house, later on dead body of his daughter was found and he raised suspicion against the son-in-law, husband of the deceased.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, there is specific allegation against Raj Kumar Sahni, husband of the deceased of killing her, only material transpired against the petitioner is that he abated the offence, more over Raj Kumar Sahni has been admitted to bail by a coordinate Bench of this Court and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Ramchandra Sahani is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Motihari, East Champaran in connection with Patahi PS Case No. 63 of 2015.
