The present writ petition has been filed seeking the following relief:- "1/A. That this application is being filed for issuance of a writ in the nature of Mandamus commanding and directing the respondents authority to remove the encroachment over the Government land bearing Khata No-124, Khesra No-230 total area measuring about

Patna High Court CWJC No.11125 of 2023(2) dt.05-09-2023 2/3 0.31 Decimal, of Mauza-Kadipur, situated at village-Kadipur Kalan, Kukurha, P.O.-Sisradh. P.S.- Itadhi, District-Buxar, the nature of the said land is "Rasta, Sarve Sadharan, and the name of the 'Raiyat' in the Kathiyan is Anabad Sarve Sadharan Bihar Sarkar & Rasta".

Further directing the respondents, to remove the said encroachment by way of comply the order passed by 'Circle Officer, Itadhi', Buxar, passed in Encroachment Case Number12/2021-22 dated 01.06.2022, Ld.

'Circle Officer, Itadhi', Buxar, during the course of the hearing of the case and also on the basis of the reports of the 'Anchal Amin' found the encroachment upon the said Road by the anti social elements for the purpose of personal use, resultant the public road has completely blocked."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Buxar for

Patna High Court CWJC No.11125 of 2023(2) dt.05-09-2023 3/3 redressal of his aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands disposed off as not pressed.
