Petitioner is named in the first information report but informant is not eye-witness and he gave name of the petitioner on the basis of suspicion. Subsequently, it is alleged that stolen motorcycle has been recovered from the house of the petitioner. Submission on behalf of the petitioner is that petitioner resides in a small hut and, as a matter of fact, so-called recovery has not been made from the hut of the petitioner rather same has been recovered from an open place.

Petitioner does not have any criminal antecedent and investigation has already been completed.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
