JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 308, 147, 149 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that on 12.11.2015 the informant and others were working in the field, in the meantime, ten F.I.R named accused persons including the petitioner came and started abusing. The accused persons made assault to Ranjit Mahto and Munna Kumar Singh and when the son of the informant Binod Kumar came to rescue then petitioner and Nand Lal Singh assaulted with iron rod on the hand and back causing fracture injury. It is also alleged that petitioner resorted to 3-4 rounds of firing. It is submitted by learned counsel for the petitioner that in the background of land dispute the

Patna High Court Cr.Misc. No.7446 of 2016 (3) dt.22-02-2016 2/2 accusation has been levelled. There is counter version of the occurrence also.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. It is submitted by learned counsel for the informant that son of the informant has also received grievous injuries at the hands of the informant.

Considering the nature of accusation and there being counter version of the occurrence, though petitioner's side also received injuries, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Tiyar P.S. Case No. 59 of 2015, pending in the Court of learned Chief Judicial Magistrate, Ara, Bhojpur.

With the observations above, the application stands disposed off.
