Petitioner seeks bail in connection with Sheohar P.S. Case No. 232 of 2017, G.R. No. 855 of 2017 for offences punishable under Sections 47, 54, 57 of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, as lodged by the police personnel, is that on secret information the Bolero car of the petitioner was searched and the petitioner along with another coaccused Mukund Baitha were apprehended. On search from the car, 45.120 liters of foreign illicit liquor was recovered. Accordingly, a seizure list was prepared.

Patna High Court Cr.Misc. No.28422 of 2018 (2) dt.11-05-2018 2/2 It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history except Sheohar P.S. Case No. 233 of 2017 lodged on the same day alleging that in the present case the petitioner escaped from judicial custody. He submits that another co-accused apprehended along with the petitioner has since been granted the privilege of bail by a co-ordinate Bench of this Court in Cr. Misc. No. 4203 of 2018 vide order dated 25.01.2018 and the petitioner is languishing in judicial custody since 05.03.2018.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-1-cum-Special Judge, Sheohar in connection with Sheohar P.S. Case No. 232 of 2017, G.R. No. 855 of 2017.
