The petitioner has filed the instant application for grant of regular bail in connection with Amas P.S. Case no. 208 of 2015 registered under sections 370 and 371 of the Indian Penal Code and section 14 of the Child Labour (Prohibition and Regulation) Act, 1986.
As per allegation in the FIR, the accused persons took away eight children to provide them job but the children were handed over to the farmers at Manali.
It is submitted by learned counsel for the petitioner that the allegation as levelled against the petitioner is false and concocted. Statements of a number of victims were recorded
Patna High Court CR. MISC. No.6776 of 2021(3) dt.30-06-2021 2/2 under section 164 Cr.P.C. which has been brought on record as Annexure 2 series to this petition. They have not taken the name of the petitioner although they have taken the name of coaccused Shambhu Paswan and Bhola Manjhi. Both Shambhu Paswan and Bhola Manjhi have been enlarged on bail vide order dated 20.4.2016 passed in Cr. Misc. No. 8688 of 2016. The petitioner is in custody since 6.7.2020.
The application for bail is opposed by learned Additional Public Prosecutor for the State who submits that the petitioner has been absconding.
Having heard learned counsel for the parties and taking into consideration the grant of bail to the co-accused and the petitioner having remained in custody since 6.7.2020, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Amas P.S. Case no. 208 of 2015 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya.
