The petitioner aged 70 years apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504,506 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that while he was working in his field, the accused persons including the petitioner came variously armed and it is alleged that petitioner assaulted the informant by axe on his head causing injury and Subhash Ray and Robin Ray assaulted the brother of the informant who had come to rescue him by lathi and iron rod.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he is a
Patna High Court CR. MISC. No.60382 of 2021(2) dt.13-07-2022 2/2 senior citizen aged about 70 years, it is next submitted that petitioner had earlier instituted Charkapathar P.S. Case No. 116 of 2019 against the present informant and his family members, it is also submitted that though the allegation of assaulting by the petitioner is by an axe but the injury report shows that the wound is lacerated caused by an iron rod.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner and the fact that petitioner is a person aged about 70 years and is a person with clean antecedent, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sono (Charkapathar) P.S. Case No. 184 of 21 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
