JUSTICE RAKESH KUMAR ORAL ORDER 07-05-2018 Heard Sri Krishna Prasad Singh, learned senior counsel , assisted by Sri Saket Kumar Singh, learned counsel for the petitioners and Sri Madan Kumar, learned Additional Public Prosecutor.
Five petitioners, who are in custody since 27.03.2018, have prayed for grant of bail in connection with Aurangabad (Town) P.S. Case No. 94 of 2018 , registered for the
Patna High Court Cr.Misc. No.27303 of 2018(2) dt.07-05-2018 2/2 offences under Sections 307, 147, 148, 149, 504, 436, 427, 160, 295A, 353 of the Indian Penal Code, 1860.
Learned senior counsel for the petitioners submits that in the case petitioners have been made accused as if petitioners were member of a procession of "Ramnavmi" and they indulged in brick- batting. It was submitted by learned senior counsel for the petitioners that petitioners have been made accused only due to the reason that they were local residents and falsely petitioners were made accused and arrested.
Considering the nature of accusation, let the aforesaid five petitioners: Om Prakash Singh, Abhishek Ranjan, Pappu Singh, Raj Kumar Singh and Monu Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad / concerned court in connection with Aurangabad ( Town ) P.S. Case No. 94 of 2018.
