JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 308, 337, 504/34 of the Indian Penal Code. The prosecution case is that the she-goat of the petitioner was grazing the rahar crop of the informant and when wife of the informant made protest then this petitioner assaulted with axe on the head and hand of the informant. When the wife of the informant came to rescue, she was also assaulted by means of lathi. It is further alleged that other family members of the informant were also assaulted. It is submitted by learned counsel for the petitioner that informant received two lacerated marginal size injuries on the left hand have been found though opinion with regard to nature of injury has been kept reserved and the wife of the informant has received swelling with tenderness on left

Patna High Court Cr.Misc. No.6337 of 2016 (2) dt.09-02-2016 2/2 shoulder, lacerated injury on middle finger and swelling on forehead. There is counter version of the occurrence and petitioner's side also received injuries.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that there is specific accusation that petitioner assaulted with axe but the medical opinion does not corroborate the accusation and there is counter version of the occurrence, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jamui in connection with Sono P.S. Case No. 189 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
