Heard the parties in virtual Court.
Petitioner seeks bail in a case registered for the offences punishable under Sections 414,467,468,471,34 of the Indian Penal Code and Sections 30(A), 38(i),41(i) of Bihar Prohibition and Excise Act, 2016.
Petitioner was not there at the time of recovery of liquor rather co-accused Ashok Kumar stated before the police that the petitioner was also in the business of liquor as retail seller. Petitioner has got no criminal antecedent. Investigation of the case is already complete.
Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.8677 of 2021(2) dt.25-06-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kudhani Police Station Case No.668 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
