Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the FIR whereas some others are named in the FIR of the occurrence of murder. Submission is that name of the petitioner has surfaced in the confessional statement of co-accused Dular Chouhan who has already been allowed bail by a Coordinate Bench of this Court vide order dated 18.04.2018 passed in Cr. Misc. No. 23084 of 2018.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.28718 of 2018 (2) dt.11-05-2018 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rajpur Police Station Case No. 288 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
