This application under Section 378(4) of the Code of Criminal Procedure has been filed seeking leave to appeal against the judgment and order of acquittal dated 11.12.2015 passed by the learned Additional District & Sessions Judge-I, Kishanganj in Cr.Appeal No. 18 of 2001 whereby he has reversed the judgment and order dated 15.02.2001 passed by the learned Judicial Magistrate 1st Class, Kishanganj in Complaint Case No. C-431 of 1993/ Tr. No. 57 of 2001 by which the accused Gautam Sinha and Mrs. Lakhi Sinha were convicted for the offences punishable under Sections 323, 498-A and 406 of the Indian Penal Code. Having heard learned counsel for the petitioner and
Patna High Court SLA No.5 of 2016 (2) dt.18-10-2016 2/2 perused the judgments passed by the trial Magistrate and the appellate court and other materials on record, leave is granted to the petitioner to file appeal against the aforesaid judgment of the appellate court. The appeal must be filed within 30 days from today failing which no appeal against the aforesaid judgment shall be entertained.
The application stands allowed.
