This application for anticipatory bail arises out of Kaler P.S. Case No. 09 of 2018, disclosing the offence under Sections 147, 148, 149, 341, 323, 506, 504, 337, 427, 353, 436, 120-B of the Indian Penal Code.

The allegation in the FIR is that in protest against death of a person in police lock-up the local public are said to have vandalised the police station and caused obstruction in due discharge of public duty by police personnel. It is alleged that there were 200-300 persons involved, out of whom 11 have been named. The petitioner is one of them.

Learned counsel for the petitioner has submitted that there is nothing specific against him.

Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Arwal in Kaler P.S. Case No. 09 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
