The petitioner seeks bail in Mairwa P.S. Case No. 37 of 2018 registered under Section 302/34 of the Indian Penal Code. Petitioner along with Brajesh Singh is said to have eliminated the nephew of the informant namely Mukesh Yadav over some altercation ten days preceding to the occurrence with the deceased.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case merely on suspicion. Motorcycle of the deceased was recovered from the possession of Pappu Yadav and said Pappu Yadav in his confessional statement

Patna High Court Cr.Misc. No.28410 of 2018 (2) dt.09-05-2018 2/2 has confessed his guilt in committing murder of the deceased by throwing him from the over-bridge resulting into his death. He has also named co-accused Rinku and Pintu in the occurrence as his associates. Said Pappu Yadav has not named the petitioner in the occurrence. There is nothing in the record indicating the complicity of the petitioner in the occurrence. The petitioner has been languishing in custody since 14.02.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Siwan in connection with Mairwa P.S. Case No. 37 of 2018.
