No. 25803 of 2014 to the extent of direction for release of the petitioner on anticipatory bail, though the Co-ordinate Bench (now retired) disposed of earlier application for anticipatory bail with liberty to move before the learned Sub-Divisional Judicial Magistrate, Katihar who was supposed to pass order in view of the ratio laid down in the case of Arnesh Kumar Vrs. State of Bihar and Another, reported in 2014(3) P.L.J.R. 314 (SC). This Court finds no ground to modify the earlier order.

The application is disposed of with the liberty to the learned court below to consider the prayer for regular bail of the petitioner, if he surrenders within a period of four weeks. Accordingly, this modification application is
