The petitioner apprehends her arrest in Suppi P.S. Case No. 182 of 2020, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that this petitioner along with others abused and assaulted the informant and family members with knife, Farsa and also alleged to have disrobed the informant and took away cash from her shop.

It is submitted that petitioner is alleged to have assaulted the informant and her son by means of iron rod and the injuries sustained by the informant and her son is simple in nature. Moreover, the occurrence took place on 07.07.2020, but

Patna High Court CR. MISC. No.61074 of 2021(2) dt.05-07-2022 2/2 the FIR was lodged on 19.07.2020 after delay of 12 days without any plausible explanation. Both parties are next door neighbour and dispute arose over petty issue. Petitioner is a lady and has got clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Suppi P.S. Case No. 182 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
