2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 304B, 201 and 34 of the Indian Penal Code.

3. It is a case of "dowry death".

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is elder brother-in-law of the deceased and has committed no offence. Petitioner has falsely been implicated in this case merely because they happen to be relatives of the husband of deceased. There is no specific allegation alleged against this petitioner and he is separate in mess and property and have got no concern with the affairs of the deceased and her husband. It is further submitted that thrust of accusation is against husband of deceased, who is already in

Patna High Court CR. MISC. No.58073 of 2024(5) dt.16-01-2025 2/2 custody since 04.10.2024. Petitioner claims clean antecedents.

5. On the other hand, learned A.P.P. for the State has vehemently, opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge, Vaishali at Hajipur, in connection with Raghopur P.S. Case No. 244 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
