====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 03-05-2018 Heard Sri S.N.P.Sinha, learned Senior Counsel, assisted by Ms. Rashmi Bharti, learned counsel for the petitioner and Sri Parmeshwar Mehta, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody in Gardanibagh P.S. Case No.58 of 2018 registered for the offence under Sections 417 and 420 of the Indian Penal Code, has prayed for grant of bail primarily on the ground of parity. It was submitted by learned Senior Counsel appearing on behalf of the petitioner that in similar circumstances, number of other accused persons have been granted bail by this Court. He has specifically placed reliance on order dated 25.04.2018 passed in Cr.Misc.No.25044 of 2018
Patna High Court Cr.Misc. No.26604 of 2018(2) dt.03-05-2018 2/2 and order dated 01.05/2018 passed in Cr.Misc.No. 25813 of 2018 to show that other accused persons in similar circumstances have been granted bail.
Considering the nature of accusation as well as the fact that other accused persons, in similar circumstances, have been extended the privilege of bail, there is no reason to deny the same relief to the petitioner. Accordingly, let the petitioner, namely, Gaurav Kumar Singh be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-cum- Sub Judge XIV, Patna, in connection with Gardanibagh P.S. Case No.58 of 2018.
