A counter affidavit is filed on behalf of the respondent no.1.
Petitioner served the Chapra Nagar Parishad as Tax Assistant Collector and superannuated w.e.f. 31.3.2014. Since the retiral dues were not paid to him, he made representation. When no heed was paid the present writ petition is filed. Mr. De, on going through the statements made in the counter affidavit, states that during the pendency of the
Patna High Court CWJC No.957 of 2015 (2) dt.06-05-2016 2/2 application dearness allowance in full have been paid/authorized. Some amount under the head(s) 'gratuity', 'leave encashment' and 'earned leave' have also been paid. For difference of pay and salary, the Court should permit the petitioner to make appropriate representation to be considered by the respondents. In so far as the amount(s) under the head(s) GPF and full payment of gratuity as well as payment of unutilized earned leave are concerned, the writ petitioner is permitted to file application to be considered by the respondent nos. 4 (the Chairman, Parishad) and 5 ( the Executive Officer, Parishad) who shall ensure payment of his admissible dues within a period of two months from the date of filing of the application with a copy of this order.
