Mr. Jai Prakash Verma, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 30-08-2022 Heard learned counsel for the petitioners, learned counsel for the State as well as learned counsel for the Informant.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 364, 302 and 201/34 of the Indian Penal Code.

It is a case of murder of the informant's son by the accused persons.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that specific allegation in participation of this offence and commission of murder is against co-accused

Patna High Court CR. MISC. No.60285 of 2021(5) dt.30-08-2022 2/2 Avinash Kumar and Prince and there is no specific allegation against these petitioners.

Learned APP and the learned counsel for the Informant have opposed the prayer for anticipatory bail of the petitioners and submitted that the deceased had been taken away by co-accused Vikash Kumar and thereafter the deceased namely, Kaushal was murdered and the petitioners helped to other co-accused in commission of the offence and escaped from the hospital with Avinash Kumar. Petitioners have clean antecedent.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-XIV, Patna in connection with Gandhi Maidan P.S. Case No. 218 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
