JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 9.3.2018 seek bail in Tarabari PS Case No. 71 of 2017 registered under Sections 302/34 of the IPC.
The allegation in brief is that the police had turn up at the house of the informant to arrest her husband who on seeing the police started escaping away then he was chased by the FIR named accused persons who are said to have indiscriminately assaulting him causing his death.
Learned Counsel for the petitioners submits that the deceased was a notorious criminal and wanted in many cases, petitioners' side had also lodged a case earlier against him so they have been falsely implicated in this case, however the allegations are general and omnibus and similarly situated other three co-accused Wazul and others have been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 16472 of 2018. Having considered the said facts and circumstances, the petitioners, namely, Md. Qaium @ Qaium, Muzaffar and Sakib are directed to be released on bail on furnishing bail bonds of Rs.
Patna High Court Cr.Misc. No.27598 of 2018 (2) dt.04-05-2018 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Araria in connection with Tarabari PS Case No. 71 of 2017.
