JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 It has been submitted that the petitioner no.4 (Meena Devi) has died during the pendency of this application, as such this application against the petitioner no.4 stands dismissed as withdrawn.
So far petitioner nos. 1, 2 and 5, above named, are concerned, they have already been granted privilege of anticipatory bail .
So far petitioner no.3 (Butan Sah) is concerned, he is apprehending his arrest in connection with Nautan (Jagdishpur)
Patna High Court CR. MISC. No.48435 of 2019(3) dt.15-11-2019 2/2 P.S.Case No.96 of 2019, registered for offences punishable under Sections 304(B), 201, 34 of the Indian Penal Code. Allegation against the petitioner no.3, who happens to be father-in-law of the deceased is of dowry death. Submission of the learned counsel for the petitioner no.3 is that no specific allegation has been attributed against him and he is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner no.3, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Nautan (Jagdishpur) P.S.case No.96 of 2019 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
