JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504 of the Indian Penal Code.

The accusation is of abusing the informant and making assault with lathi and danda. It is specifically alleged that petitioner no.1 assaulted with iron rod on the head of the informant.

It is submitted by learned counsel for the petitioners that the injury of the informant has been found to be simple. The petitioners are agnates of the informant and there is counter version of the occurrence also. Subsequently, the informant has

Patna High Court Cr.Misc. No.6762 of 2016 (2) dt.15-02-2016 2/2 retracted from his initial version. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Madhepura in connection with Kumarkhand (Belari O.P.) P.S. Case No. 143 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
