JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 348, 323, 504, 379, 34 of the Indian Penal Code.

The prosecution case is that on 19.07.2015 when the informant was sitting at his door, his wife, Renu Devi, went back of the house to ease then the petitioner tried to outrage her modesty and tore her blouse. When the informant went to rescue her then the family members of the petitioner tied him with a tree and assaulted him.

It is submitted by the learned counsel for the petitioner that in the backdrop of land dispute the accusation has been

No.6745 of 2016 (2) dt.15-02-2016 2/2 labelled, for the occurrence of 19.07.2015 the FIR was registered on 16.08.2015 and petitioner side, at earlier point of time, lodged Bhagwanpur P.S. case No. 200/ 2015 against the informant side. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering nature of accusation and delay in lodging the FIR, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 202 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
