The petitioner, already in custody, seeks bail in connection with Aurangabad (Town) P.S.Case No. 94 of 2018 registered under Sections 147, 148, 149, 160, 295, 307,353, 427, 436 and 506 of the Indian Penal Code.

Allegation in brief is that on the occasion of Ramnavmi procession, a communal riot broken out and both sides raised slogan against each other and threw brick bating. Submission is that a large number of people have been made accused however no specific overt act is alleged against anyone including the petitioner and he has no criminal antecedent except a case lodged for the same occurrence against him and is in custody since 27.03.2018.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.27704 of 2018(2) dt.07-05-2018 2/2 the petitioner, namely , Kislay Kumar @ Ishu Kumar @ Kishlay Kuwar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Aurangabad (Town) P.S.
