07-05-2018 Heard Sri Binay Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Gardanibagh P.S. Case No. 59 of 2018 registered for offence under Sections 417/420 of the Indian Penal Code, has prayed for grant of bail, primarily, on the ground that other accused persons, having similar accusation, have been granted bail by this Court. Learned counsel for the petitioner submits that petitioner was a candidate for appointment as Constable and he has been detained on allegation that his finger-print was not matching with the finger-print obtained in the written test. Learned counsel for the petitioner has also drawn my attention to statement made in paragraph 3 of the petition to show that petitioner is having clean antecedent.

No.27736 of 2018(2) dt.07-05-2018 2/2 Considering the nature of accusation, clean antecedent of the petitioner as well as fact that some of the accused persons, having similar accusation, have been granted bail, there is no reason to refuse the prayer of the petitioner. Let the petitioner namely Brij Kishore Kumar @ Braj Kishor Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge XIV-cumA.C.J.M., Patna in connection with Gardanibagh P.S. Case No. 59 of 2018.
