1. Heard the parties.

2. The petitioners apprehend their arrest in connection with Majhaulia P.S. Case No. 39 of 2025 dated 17.01.2025 registered under section 126(2), 127(2), 115(2), 140(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the first information report the petitioners along with other accused persons brutally assaulted the brother of the informant and wrongfully confined him where after he became traceless. The victim has not yet been recovered.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case due to

Patna High Court CR. MISC. No.48749 of 2025(2) dt.12-08-2025 2/2 previous dispute between the parties. F.I.R. has been lodged after delay of two days.

5. I have heard learned counsel for the parties and have gone though the material on record including the impugned order. From the impugned order it appears that during the course of investigation the witnesses have stated that the brother of the informant was brutally assaulted by the petitioners. The victim has not yet been recovered. The investigation of the case is still going on.

6. Considering the aforesaid, the serious nature of allegation, the fact that victim has not yet been recovered and investigation is still going on for which custodial interrogation of the petitioners may be required, accordingly, I am not inclined to grant anticipatory bail to the petitioners. The same is rejected.
