====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 09-04-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State through video conferencing.

The petitioner has filed the instant application for grant of regular bail in connection with Chausa P.S. Case no. 267/2019 registered under sections 341, 323, 384, 504, 506 and 34 of the Indian Penal Code.

As per allegation in the first information report, seventeen accused persons including the petitioner herein came to the house of the informant and beat him up with slap etc. It is further stated that the petitioner has threatened him for rangdari of Rs. 50,000/- and, thereafter, they gave threats through coaccused Sanjay Singh. It is submitted by learned counsel for the petitioner that the allegations against the petitioner are false and

Patna High Court CR. MISC. No.6685 of 2021(2) dt.09-04-2021 2/2 concocted. The petitioner has been falsely implicated in the case because of business rivalry. The petitioner is in custody since 6.7.2020 i.e. for more than nine months and chargesheet has been submitted in the case.

The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the period in custody, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Chausa P.S. Case no. 267/2019 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Udakishunganj, District Madhepura.
