The petitioner seeks bail in connection with Pasraha P.S. Case No.108 of 2018/Sessions Trial No.98 of 2019 registered under Sections 304(B) and 201/34 of the Indian Penal Code, pending in the court of the Sessions Judge, Khagaria. The accusation is of killing the deceased, the daughter of the informant, by her husband and other in-laws for non-fulfillment of the dowry demand within two years of her marriage, while she had a male baby of seven months, and disposing of the dead body of the deceased, the daughter of the informant.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.48127 of 2019(3) dt.04-12-2019 2/2 petitioner submits that, admittedly, the petitioner is the husband of the deceased. While the deceased showed her desire to go to her parental house but the family members of the petitioner did not permit her to go to her parental house, due to that reason, the deceased committed suicide. After giving information to the informant regarding the same, the dead body of the deceased was cremated but with an ulterior motive, the informant has lodged the present case against the petitioner and his family members. Th petitioner is in custody since 29.10.2018. Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
