The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 385, 387, 307, 504 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that the accused persons came variously armed, resorted to fire in the air to create terror, demanded extortion of rupees two lakhs and took away the tractor of the informant.

It is submitted by learned counsel for the petitioners that the informant while parking his tractor in the

Patna High Court Cr.Misc. No.7069 of 2016 (2) dt.16-02-2016 2/2 crop field of petitioners damaged the crop which led to some scuffle took place. There is a counter version of the occurrence being Suryagarha P.S. Case No. 226 of 2015 levelling accusation under Sections 147, 148, 149, 341, 323, 427, 379, 307, 504 of the Indian Penal Code and 27 of the Arms Act against the informant and admittedly there is no injury caused to the informant.

A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Suryagarha P.S. Case No. 225 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
