Petitioner seeks bail in Daudpur P.S. Case No.56 of 2019 instituted for the offence under Section(s) 392 Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that Petitioner is in custody since 26.04.2019.

In the written report it is alleged that on the date of occurrence petitioner snatched amount of rupees three lac thirty thousand from possession of the petitioner.

Counsel for the petitioner submits that there is no identifying marks on the money. The Sessions Judge has mentioned in the impugned order that police has recorded

Patna High Court CR. MISC. No.48610 of 2019(2) dt.08-08-2019 2/2 confessional statement of the petitioner. Looted money and SBI Kiosk identity card have been recovered from house of the petitioner, which finds mention in para 23 of the case diary. Counsel for the petitioner submits that informant has not given description of the alleged amount in the First Information Report, which may substantiate that the amount recovered is looted amount.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, XIV, Saran at Chapra, in connection with Daudpur P.S. Case No.56 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
