2. The petitioner seeks bail in Salaiya P.S. Case No. 156 of 2023 registered for the offence punishable under Section-330(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

3. It is alleged that on the tip off, the informant along with other police officials reached at the place of occurrence and found some persons fleeing away leaving Alto Car and a motorcycle. On search, 330 litres of illicit liquor is said to have been recovered from the motorcycle and Alto Car.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that the petitioner is neither the owner nor the driver of the seized vehicles in question. The petitioner was

Patna High Court CR. MISC. No.52236 of 2024(2) dt.31-07-2024 2/2 not present at the place of occurrence rather he has been arrested from some other place. The petitioner is in custody since 17-06-2024.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances and also the fact that the recovered Ganja is less than commercial quantity, the petitioner named above, is directed to furnish bail bond in the court below after three months in custody and on doing so, the petitioner shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Excise-Ist, Aurangabad, Bihar in connection with Salaiya P.S. Case No. 156 of 2023 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
