Earlier, the bail petition of petitioner was rejected, vide order dated 02.03.2021 passed in Cr.Misc. No. 36722 of 2020 with following observation:

"The trial court is directed to hold the trial on day to day basis and conclude the same within six months from the date of receipt of this order. If the trial is not concluded within six months, the petitioner, if so advised, may renew his prayer for bail."

The trial court report reveals that the case has only been committed to the court of learned District & Sessions Judge, Gaya on 11.04.2022. Meaning thereby that there is no adequate progress in trial and petitioner is in custody since 13.05.2020.

Patna High Court CR. MISC. No.60327 of 2021(4) dt.21-04-2022 2/2 Considering the period of custody and stage of the trial, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Sherghati, District - Gaya in connection with Sherghati (Dobhi) P.S. Case No. 206 of 2020.
