JUSTICE ARUN KUMAR ORAL ORDER 07-05-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 25.1.2018, seek bail in Nirmali PS Case No. 41 of 2017 registered under Sections 302, 201, 379 and 120B of the IPC.

The allegation in brief is that the informant (deceased's father) went out of the home in search of his son in the village and found these two petitioners along with two others coming out of the Middle School and enquired about his son but could not get any answer, later on dead body of his son was found on the bank of the river then one Shyam Sunder Mahto came and asked not to lodge case, it is alleged that Shailenda Kamat has killed his son while robbing money from his possession.

Learned Counsel for the petitioner submits that except raising suspicion against the petitioner there is no other material, other co-accused named in the FIR namely Deepak Kumar, Ritesh Kumar, Suman Kumar have been granted bail by coordinate Benches of this Court including bail of one co-accused Bittu Kumar by this Court, moreover the petitioners have no criminal antecedent.
