====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Dhaka (Pachpakari) P. S. Case No. 31 of 2021 in a case registered for the offence punishable under Section 30(a) of the Indian Penal Code.

3. As per the prosecution case, 87 liters county made liquor in 290 bottles was recovered from orchard of one Nirul Haque which is said to have been concealed by this petitioner.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is in custody since 07.06.2024.

5. Learned A.P.P. for the State vehemently opposed

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No. 01, East Champaran, Motihari in connection with Dhaka (Pachpakari) P. S. Case No. 31 of 2021.
