The petitioners apprehend their arrest in connection with Barachati P.S. Case No.207 of 2020, registered for the offences punishable under Sections 498A, 436, 307 and 34 of the Indian Penal Code.
Petitioner No.1, Malti Kumari alongwith other coaccused persons used to torture the informant. It is also alleged that on 18.04.2020 at about 11.45 P.M. her Sautan, Kajal Kumari firstly assaulted the informant and then after locking her in the room try to set her on fire.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the
Patna High Court CR. MISC. No.51403 of 2022(2) dt.13-12-2022 2/2 present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the matter has been compromised between the parties.
Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.
Considering the facts that the petitioners and female and matter has been compromised between the parties, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, Gaya in connection with Barachati P.S. Case No.207 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) Sanjay/- U T
