JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-11-2025 Heard learned counsel for the petitioner, learned counsel for the informant as well as the learned APP for the State.
2. The petitioner apprehends his arrest in connection with Deo P.S. Case No. 54 of 2024, registered for the offences punishable under Sections 323, 379, 500, 503, 504, 506, 406, 498A of the IPC and Section 3/4 of the D.P. Act.
3. It is a case of matrimonial dispute.
4. Vide order dated 19.11.2024, the matter was referred to the Patna High Court Mediation and Conciliation Centre for exploring the possibility of amicable settlement of the dispute between the parties.

5. It has jointly been submitted that the mediation has become successful. The terms and conditions of the compromise entered into between the parties has been annexed with the mediation report dated 03.01.2025. It has further been submitted that the first motion of divorce case filed by both the parties on the basis of mutual consent under Section 28 of the Special Marriage Act, 1954 has been done and the petitioner shall pay the rest of the amount at the time of second motion.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Deo P.S. Case No. 54 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
7. If either of the parties retracts from the terms and conditions of compromise, the learned court below may pass appropriate orders.
