2. The petitioner seeks regular bail in connection with Shakurabad P.S. Case No. 145 of 2022, registered for the offence punishable under Sections 302, 379 of the Indian Penal Code, r/w sec-34 of the said code and section 27 of the Arms Act.

3. As per Prosecution, the deceased was called by the petitioner and others and subsequently he has been killed. Coaccused Bittu Kumar has confessed his guilt in which he has also taken the name of petitioner having participated in the crime. Petitioner is in judicial custody since 10.01.2023.

4. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.56989 of 2023(2) dt.30-08-2023 2/2 for bail.

5. Considering the fact that there is no direct evidence against the petitioner, this application is allowed.

6. Let the petitioner, above named, be released on bail after completing one year in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class- cum- Addl. Munsif, Jehanabad in connection with Shakurabad P.S. Case No. 145 of 2022.

7. This is also subject to the condition that the petitioner shall mark his presence in Main (Belaganj) Police Station, District- Gaya on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below. (Sandeep Kumar, J) Ranjeet/- U T
