2. The petitioner was appointed on compassionate ground in Group D post in the office of the Chief Engineer, Electric Supply Region, PESU, Patna. On 5th of October, 1994, it is submitted by the petitioner that his father died in-harness on 22nd of September, 1992 and at the time of his death, the petitioner had academic qualification of post-graduation. He graduated in the year 1985 and got a degree of post-graduate in 1998. It is also contended by the petitioner that the candidates having graduation degree under similar circumstances were

Patna High Court CWJC No.11986 of 2024(2) dt.13-08-2024 2/2 posted as Class III employee in the Board. However, the petitioner was appointed as Class-IV employee. He submitted representations on 16th of July, 2012, 12th of September, 2012 and 26th of October, 2012, praying for appointment in Class-III post but the respondent authority failed and neglected to consider his prayer.

3. It is the respondent authority who will decide administratively as to whether the petitioner is entitled to get appointment in Class-III post on compassionate ground or on attainment of his seniority.

4. For the reasons stated above, the petitioner is directed to send a copy of the instant writ petition to the Respondent Nos. 2 and 3 who shall treat the writ petition as a representation of the petitioner and dispose of the representation by issuing administrative order after giving the petitioner an opportunity of hearing.

5. With the above order, the instant writ petition is disposed of.
