The petitioner seeks bail in connection with Bachhwara P.S. Case No. 125 of 2025 instituted for the offence under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023. 3.

On 09.04.2025, while travelling with tar drums in his pickup, the informant was stopped near Bachhwara by four persons on a white Apache bike, who abused and assaulted him. They snatched his mobile phone and Rs.10,000/- after forcibly taking him to the roadside.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.51223 of 2025(2) dt.11-08-2025 2/3 that the petitioner is in custody since 10-04-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. So far as recovery is concerned, looted mobile was recovered from the possession of co-accused, Shivam Kumar. There is no witness to the occurrence. There is no injury on record. There is no material against the petitioner in the present case. Other co-accused has been granted bail by this Court vide order dated 06-08-2025, passed in Cr. Misc. No. 50778 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and manner of petitioner's implication, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
