Petitioner, already in custody, seeks bail in connection with Complaint Case No.1628C/2017, giving rise to Trial No.431/2018, registered under Sections 376, 313 and 506 of the Indian Penal Code.
Allegation in brief is that the petitioner used to sexually exploit the prosecutrix for last 7-8 years on promise to marry with her and several times she was aborted. Learned counsel for the petitioner submits that the complainant is the cousin of petitioner's wife and prior to this occurrence, her mother vide Annexure-2 had lodged a police
Patna High Court Cr.Misc. No.28019 of 2018(2) dt.09-05-2018 2/2 case alleging that Rs.50,000/- given to the petitioner as loan was not being repaid and on account of that dispute, the petitioner has falsely been implicated in the present case by a lady who is 26 years old. The matter went even to the Mahila helpline too and Rs.1,50,000/- was paid by the petitioner and the petitioner is a teacher in a government school.
Having considered the aforesaid facts and circumstances, petitioner Ramayan Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Complaint Case No.1628C/2017, giving rise to Trial No.431/2018.
