Earlier, the bail petitioner of petitioner was rejected, vide order dated 01.02.2021 passed in Cr.Misc. No. 26767 of 2020.

It is submitted on behalf of the petitioner that during pendency of this bail petition, co-accused namely Rajnish Kumar Mishra @ Ranu Mishra @ Rajnish Mishra, having similar allegation, has been granted bail by a coordinate Bench of this Court, vide order dated 05.01.2022 passed in Cr.Misc. No. 55723 of 2021. In this case, charge has already been framed, but there is no adequate progress in the trial and petitioner is in custody since 14.01.2020.

Learned A.P.P. for the State has opposed the bail

Considering the period of custody of petitioner and the fact that similarly situated co-accused has already been granted bail and there is no substantial progress in trial, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XII, Patna / concerned court in connection with Patliputra P.S.
