The petitioner seeks bail in connection with Sasaram (M) P.S. Case No. 209 of 2018 for the offences punishable under Section 414 of the Indian Penal Code and Sections 30(a), 34 and 38 of the Bihar Prohibition & Excise Act, 2016.
The allegation is regarding recovery of 100 liters of illicit liquor from an auto rickshaw being driven by the petitioner herein.
The learned counsel for the petitioner submits that no recovery whatsoever has been made from the conscious possession of the petitioner herein and he is merely a driver of the auto rickshaw which was being occupied by other co-accused
Patna High Court Cr.Misc. No.29809 of 2018 (2) dt.21-05-2018 2/2 person at the time of being apprehended by the Police. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 20.03.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Court, Excise, Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 209 of 2018.
