The petitioner is apprehending his arrest in connection with Chapra Rail P.S.Case No.163 of 2018 registered for offences punishable under Section 379 of the Indian Penal Code.

Allegation as per the FIR is of theft of the purse of the wife of the informant. Petitioner is not named in the FIR and later on his name transpired in the confessional statement. Apart from that it appears that he has criminal antecedent also as he is accused in two other cases also.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner so far this case is concerned.

Heard learned A.P.P. , who has opposed the pray for bail

Patna High Court CR. MISC. No.46946 of 2019(2) dt.30-07-2019 2/2 on the ground of nature of the allegation as well as the antecedent of the petitioner. .

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may surrender before the learned court below and pay for regular bail.

With the aforesaid direction, this application is dismissed.
